I have been told on a number of occasions that this amendment is obsolete. I beg to differ but here is the argument. In today’s society the government would never think of quartering troops in people’s homes so we might as well get rid of this one. The question I ask is a chicken or the egg question. Is it really society has change so the amendment needs to go or is it because of this amendment that our society has become what it is so it no longer considers quartering of troops in people’s homes simply because it has never been allowed to so it has adapted.
I think it needs to stay because the moment you give the government this power thy will take it. Government is like that. The founding father understood this and had recently experienced this problem. You need to understand that during the British occupation people had to put up British soldiers, feed them and support them. Let’s understand this is a big temptation for goverenemnt if this is allowed. Suddenly they no longer have to quarter troops or feed them in time of peace. Citizens have to pick that up so all the military would have to do is provide arms and place to train. That would be a lot of money saved which would be picked up by a few while other pays nothing. If anything today this guarantees that all tax paying citizens share the burden of quartering and keeping troops not just the few that have occupied houses.
Time f war is different of course as a persons home may become the front lines or be in a zone of battle. It is a reasonable exception but it also can only be done according to what laws are prescribed for it.
We need to keep this one in place because it limits and curtails government power. The moment it no longer exists the governemnt would take advantage of its absence.
